When our clients are parties to a contract that is in dispute, we counsel them on how to settle the dispute out of court, or in court, if necessary (see Litigation / Arbitration section).
Our clients are small, medium-sized and large firms and companies. We advise them in all matters of Swiss company law. Our legal advice covers everything from choosing the right corporate structure and legal form for Switzerland and designing, drafting and negotiating shareholders’ agreements, to analyzing and implementing corporate governance and housekeeping practices and assisting with cases of overindebtedness and insolvency.
We advise our clients on the legal issues involved in collective investment schemes by helping them select an appropriate structure and assisting with their distribution in Switzerland.
We also have access to a network of foreign collective investment providers.
We advise our clients in asset planning, especially estate planning, and in all issues related to corporate succession planning, such as wills and testamentary pacts, prenuptial agreements, and trusts and foundations.
We assist and represent our clients in disputes in these areas by drawing on our many years of experience in multi-jurisdictional disputes over estates, especially those involving Anglo-American law (see Litigation / Arbitration section).
We also counsel our clients in legal disputes in the areas of law that we practise. As part of this process, we start by sounding out the possibility of an out-of-court settlement. If that is impossible, we represent our clients in legal actions and proceedings before Swiss courts and authorities, as well as Swiss and international arbitral tribunals. In fact, we have developed specialized expertise in representing clients in cases of negligent investment advice and asset management, as well as in inheritance disputes where forced heirship provisions have been violated by trusts or foundations, for example.
In addition to representing our clients in legal disputes, we also accept engagements as arbitrators in the field of international arbitration.
Although we are independent, we do work with designated domestic and foreign specialists as needed. For example, our firm has access to a network of tax experts that can be consulted if necessary to clarify national and international tax issues.
